Some legal experts not involved in the case said the courts might remedy the situation, but the record so far appeared to support Prudential.
Late last month, United States District Judge Milton Pollack, who is overseeing the class action, ruled that a plaintiff with another active case was part of the class because of his failure to opt out. But in that case, the plaintiff received notification of the class action, informed his lawyer, and then chose to do nothing.
